Matters Clients Often Ask About

How long does a civil dispute typically take before it is resolved? +
Duration varies considerably by matter. A Sessions Court claim for a straightforward debt may move through to judgment in 12–18 months. A contested High Court commercial dispute involving extensive discovery and multiple witnesses may run two to four years. Pre-action advisory and settlement negotiations frequently resolve matters before any filing, which is the most time-efficient path where circumstances allow. We provide a realistic timeline estimate in the initial written matter assessment.
What court fees should I expect to pay? +
Court fees in Malaysia are governed by the Courts of Judicature Act and subordinate legislation. Filing fees for a writ in the High Court begin at RM 240 for claims up to RM 500,000 and scale upward. Separate fees apply for each interlocutory application and for trial hearing fees. We prepare a written cost schedule at the outset of each engagement so that court disbursements are not a later revelation.
Is an initial consultation charged separately? +
An initial correspondence consultation — where the client describes the matter in writing and receives a written response from a member of the firm — is not separately charged. Where a client requires a longer in-person meeting with detailed oral advice, this forms part of the Pre-Action Advisory engagement at RM 1,500, which covers the meeting, written assessment, and one demand letter if appropriate.
What is the limitation period for bringing a civil claim in Malaysia? +
Under the Limitation Act 1953, most contract and tort claims must be commenced within six years of the cause of action arising. Recovery of land carries a twelve-year period. Certain statutory claims have shorter periods — some as brief as three years. The limitation analysis is part of every matter assessment we prepare, as proceeding outside the limitation period ordinarily bars the claim entirely.
Can costs be recovered from the other side if we succeed? +
Malaysian courts generally follow the principle that costs follow the event — meaning a successful party is ordinarily entitled to a costs order against the losing party. However, the amount awarded on taxation is typically less than the actual solicitor-client fees paid. The gap depends on the scale of the matter and the judge's discretion. We discuss realistic cost recovery expectations at the outset rather than treating it as a guarantee.
How do appeals differ from the original trial in terms of procedure? +
Appellate proceedings are primarily paper-based. The Court of Appeal reviews the record from the lower court — no new witnesses are called as of right, and fresh evidence requires leave. Written submissions carry significant weight. The appeal must generally be filed within one month of the judgment date for civil matters. The Federal Court hears only matters involving important questions of law, and leave to appeal must first be obtained.
